General Legislation Committee Holds Hearing on Draft Organic Law to Create the Constitutional Court

The General Legislation Committee of Parliament heard, on Tuesday, the deputies who authored an organic bill aimed at establishing the Constitutional Court—a key institution foreseen by the 2022 Constitution but still not operational.

According to a press release from the Assembly of People's Representatives, the hearing focused on Bill No. 100/2025 concerning the creation of the Constitutional Court, which will be responsible for:

  • Reviewing the constitutionality of laws and treaties
  • Ensuring the supremacy of the Fundamental Law

Committee Chair Highlights the Bill’s Significance

Chairman Faouzi Daâs emphasized the importance of the draft, stating that the establishment of the Constitutional Court is essential for strengthening the rule of law and implementing the provisions of the Constitution adopted in July 2022.

He also announced that the committee will continue its consultations with other stakeholders, including representatives of the executive branch, as part of a participatory approach.

Deputies Outline the Scope of the Proposal

The deputies who introduced the initiative clarified that their proposal seeks to activate Articles 125‑132 of the Constitution, which define:

  • The composition of the Court
  • Its competencies
  • The procedural rules governing its operation

The draft also sets out the procedure for raising a constitutional exception, which may be invoked by:

  • The President of the Republic
  • A group of parliamentarians
  • Under certain conditions, individual litigants before the courts

Calls for Accelerated Adoption

Several deputies urged the Parliament to speed up the review and adoption of the bill, presenting it as a crucial step toward completing the institutional architecture mandated by the Constitution.
